1. Introduction
Welcome to OpenResourceLounge ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at openresourcelounge.sbs (the "Service") operated by OpenResourceLounge.
By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
2. Service Overview
OpenResourceLounge offers first-class yacht charter services, which include, but are not limited to:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multi-day charters
Service availability is subject to weather conditions. We retain the authority to revise or cancel services without prior notice.
3. Booking and Reservations
3.1 Booking Process
To reserve a charter, the following requirements must be met:
- Minimum age requirement of 18 years
- Provision of accurate and complete details
- Payment of the necessary deposit as outlined in your booking confirmation
- Acceptance of these Terms & Conditions
3.2 Confirmation
Reservation confirmation is subject to payment receipt and our formal acknowledgment. We hold the discretion to decline service to any individual.
3.3 Availability
Availability of charters depends on vessel accessibility and favorable weather conditions. We will strive to satisfy your preferred scheduling.
4. Payment Terms
4.1 Pricing
All pricing details are presented in € and include all applicable taxes unless indicated differently. Prices are susceptible to change without forewarning.
4.2 Payment Schedule
- Deposit: 50% of the total charter fee is due upon reservation
- Balance: Must be settled 48 hours before the charter's commencement
- Any additional fees: Payable post-charter completion
4.3 Payment Methods
We accept various forms of payment, including major credit cards, bank transfers, and certified cheques. All payments are processed using secure, encrypted methods.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If cancellation occurs more than 72 hours before departure: full reimbursement minus processing charges
- Cancellations made between 24 to 72 hours before departure result in a 50% refund
- Cancellations less than 24 hours before departure will not be refunded
5.2 Weather Cancellations
Should the weather be deemed hazardous by our captain, we will propose to:
- Rebook your trip for the next available slot at no extra cost
- Issue a complete refund if rescheduling is unfeasible
5.3 Mechanical Issues
If mechanical issues arise with the designated vessel, we will try to offer an appropriate replacement. If no alternative is available, a full reimbursement will be made.
6. Safety and Conduct
6.1 Safety Requirements
It is mandatory for all guests to:
- Heed all directives from the crew
- Utilize provided safety gear as necessary
- Disclose any health conditions that could impact their safety
- Stay within the allocated areas on the vessel
6.2 Prohibited Items
The following items are prohibited on board:
- Glass containers
- Illegal substances
- Firearms or weapons
- Excessive amounts of beverages (beyond reasonable consumption)
- Pets (exceptions made if pre-approved)
6.3 Conduct
Passenger behavior should remain courteous at all times. A charter may be terminated prematurely, without refund, if conduct endangers safety or interferes with others' experience.
7. Liability and Insurance
7.1 Our Liability
Our responsibility is limited to the charge paid for your charter. We are not accountable for:
- Injuries caused by guests' heedlessness
- Loss or destruction of personal belongings
- Indirect, incidental, or punitive damages
- Delays due to weather or events outside our influence
7.2 Insurance Coverage
Our operations and fleet are protected under a comprehensive marine insurance policy. Passengers should ensure they have appropriate travel and personal insurance coverage.
7.3 Assumption of Risk
By engaging in our chartering activities, you concede that inherent risks are involved and accept accountability for your own safety and well-being.
8. Modifications and Itinerary Changes
We preserve the right to adjust itineraries, paths, or schedules due to weather, safety concerns, or operational demands. We will endeavor to offer alternative experiences of comparable value.
9. Force Majeure
Our company is not liable for any disruption resulting from forces beyond our control, including, but not restricted to:
- Severe weather
- Natural catastrophes
- Governmental restrictions
- Port closures
- Mechanical breakdowns
10. Privacy and Data Protection
We manage your personal details following our Privacy Policy. You consent to the collection and utilization of your data as described in this policy by using our services.
11. Intellectual Property
Our website's content, such as text, visuals, logos, and images, is safeguarded by copyright and trademark laws. You are not allowed to duplicate, disseminate, or generate derivative works without our explicit consent.
12. Governing Law
These Terms are regulated by the laws applicable in Spain. Any disagreements shall be adjudicated by the courts located in Valencia, Spain.
13. Changes to Terms
We hold the right to alter these Terms as necessary. Any revisions will be posted on our website, along with the alteration date. Continued service use signifies agreement to the revised terms.
